4. 說明文件。任何有權存取　貴用戶 Android 裝置者，皆得基於　貴用戶內部參考之目的，複製及使用該說明文件。

5. 移轉至其他 ANDROID 裝置。　貴用戶得將軟體解除安裝，再安裝至其他　貴用戶所擁有或掌控之 Android 裝置上，供自己使用。

6. 出口限制。軟體受美國出口法令規定的規範。　貴用戶必須遵守適用於軟體的一切本國及國際出口法令規定。這些法規包括目的地限制、最終使用者限制和最終使用用途限制。如需詳細資訊，請瀏覽 www.microsoft.com/exporting。

a. 美國。若　貴用戶在美國境內取得軟體，本合約之解釋或任何違反本合約所衍生的索賠，無論是否有法規衝突產生，均應以美國華盛頓州之法律做為準據法。所有其他訴訟將以　貴用戶居住之州法律為準據法，包含與州消費者保護法、不公平競爭法和侵權行為相關的訴訟。

b. 美國境外。若　貴用戶在美國以外的國家/地區取得軟體，則本合約應以　貴用戶所居住之國家/地區的法律為準據法。

10. 法律效力。本合約敘述了特定的法律權利。　貴用戶所在國家/地區的法律可能會賦予　貴用戶其他權利。此外，　貴用戶向其取得軟體的當事人可能也會提供相關的權利。若　貴用戶所在國家/地區法律不允許，則本合約無法改變　貴用戶所在國家/地區之法律賦予　貴用戶的權利。

11. 無瑕疵擔保責任。軟體係依「現況」授權給　貴用戶。　貴用戶須自行承擔使用風險。MICROSOFT 不提供任何明示擔保、保證或條件。　貴用戶所在地區的法律可能會提供本合約無法改變的額外消費者權利或法律保證。在　貴用戶所在地區法律的允許範圍內，MICROSOFT 排除適售性、符合特定目的或未侵權的默示擔保。

僅適用於澳大利亞：　貴用戶依據澳大利亞消費者法律 (AUSTRALIAN CONSUMER LAW) 享有法定保證，本合約條款並不意圖影響這些權利。

12. 救濟與損害賠償責任之限制與排除。　貴用戶僅能就直接損害且以　貴用戶購買軟體所支付之金額為上限請求 MICROSOFT 及其供應商負擔損害賠償責任。　貴用戶無法就其他損害 (包括衍生性損害、利潤損失、特殊損害、間接損害或附隨性損害) 請求損害賠償。

這項限制適用於

· 與軟體、服務、第三方廠商網站上的內容 (包括程式碼) 或第三方廠商程式相關的任何事項；和
