Skype for Business Online PSTN services use terms

Microsoft offers four Skype for Business PSTN Services, integrated with the existing Skype for Business and Office 365 Services available from Microsoft. This integration allows our customers to deliver a more complete end user experience and to unify the administrative and management experience for additional services using standard Microsoft tools and technologies within Office 365.

These four services address customers’ needs for PSTN Services hosted in the Microsoft cloud with PSTN Calling (available in two plans PSTN Domestic Calling and PSTN Domestic & International Calling), PSTN Conferencing, and PSTN Consumption Billing. Each service is described below and is subject to the Microsoft Skype for Business Online PSTN Services Use Terms section later in this document.

Skype for Business PSTN Services

PSTN Calling Plans

PSTN Calling plans enable customers to seamlessly integrate PSTN Calling features with Cloud PBX, all purchased from Microsoft or Microsoft partners and provisioned via Office 365. PSTN Calling features include number porting, new number acquisition, and number assignment to users. The PSTN Calling service includes regulated telecommunications features such as emergency calling. Number assignment is based upon the country to which a user is assigned in Office 365. PSTN Calling Plans are available in two plans—PSTN Calling Domestic and PSTN Calling Domestic and International. Both plans are billed on a per user per month basis.

PSTN Domestic Calling Plan enables users with the license assigned to them to receive inbound calls to their Skype for Business telephone number or call out to numbers located in the country to which they are assigned in Office 365. For example, a user located in the United States will be able to receive calls on their Skype for Business US telephone number from anyone calling from anywhere in the world, and will be able to call out to US domestic telephone numbers. Moreover, a user located in the United Kingdom will be able to receive calls on their Skype for Business UK telephone number from anywhere in the world, and will be able to call out to UK domestic telephone numbers.

PSTN Domestic & International Calling Plan enables users with the license assigned to them the same capabilities as described in the PSTN Domestic Calling plan, and additionally, the ability to call out to international numbers in 196 countries worldwide.

Both PSTN Calling plans are subject to usage limits based on the total number of subscriptions purchased, aggregated for use by all users at the tenant level. These usage limits are detailed in the PSTN Services use terms below.

PSTN Calling plans require Cloud PBX, either licensed standalone or through the E5 suite.

PSTN Conferencing

PSTN Conferencing enables customers to seamlessly integrate PSTN services into their Skype meeting experience within Office 365. PSTN Conferencing includes dial in access to meetings from the PSTN via standard toll numbers and dial out to domestic numbers from within meetings for users located in countries where domestic dial out is included. Domestic dialing is based on the country to which the meeting organizer is assigned in Office 365. Domestic dial out will initially be available to end users in the 44 countries listed below in the use terms.

Dial out to international destinations, dial in via toll free numbers, and domestic dial out for countries where domestic dial out is not included are billed using Skype for Business PSTN Consumption in a pay as you go fashion and priced at variable per minute rates per country. Please see details on which domestic destinations are included as part of your subscription and which domestic destinations are charged per minute using PSTN consumption billing.

As an introductory offer to customers from December 1, 2015 through January 31, 2017, Microsoft is providing dial-out to the 44 dial-in included countries at no additional charge to customers, whether this represents a domestic number for meetings organized by users based in one of the 44 countries or an international call for meetings organized by users based outside of the 44 countries.

PSTN Consumption Billing

PSTN Consumption Billing enables customers to extend their PSTN Calling & Conferencing experience to beyond what is included in these offers. A customer with PSTN Consumption Billing enabled begins the month with an initial balance monetary amount that extends from the previous month (and is set by the customer for the first month). As the customer consumes minutes, the balance decreases (see “Learn More” for detailed minute prices). When the customer’s balance reaches a certain minimum threshold (set by the customer), the customer has the option of either enabling Auto-Recharge which automatically replenishes the balance when the balance depletes to a minimum threshold defined by the customer –OR- manually adding funds to the balance.

At the end of each month, the customer is billed the sum of all manual and automatic amounts added to the balance during the month. Any balance remaining at the end of a given month is carried forward to the next month as initial balance.

Funds will be applied only to Skype for Business PSTN Consumption services at Microsoft’s published rates when the services are used. Any funds not used within 12 months of the purchase date will be forfeited.

PSTN Consumption Billing does not automatically apply to all users on the tenant, but rather (a) the IT admin has to assign consumption to specific users, and (b) only the users to which consumption are assigned have access to services requiring by a consumption balance. Users who do not have a PSTN Consumption Billing assigned to them individually will be subject to suspension of service once the aggregated tenant calling minute caps are consumed.

Auto-recharge: The auto-recharge service enables customers to automatically replenish their monetary balance after reaching a minimum threshold (both replenishment amount and minimum threshold are set by the customer)

PSTN Consumption Billing can be used in one or more of the following cases:

  • Customer consumed the allotted domestic minutes in their PSTN Domestic Calling Plan and needs to continue calling beyond the allotted minutes allowed per month.

  • Customer consumed the either the allotted international or domestic minutes in their PSTN Domestic and International Calling Plan and needs to continue calling beyond the allotted minutes allowed per month.

  • Customer needs to place outbound calls from a PSTN conference to an international or domestic location that is not included in their PSTN conferencing subscription (see use terms for details).

  • Customer enables inbound Toll Free numbers used with either PSTN Conferencing or PSTN Calling. Toll free numbers are billed a rate per minute which varies depending on which country the toll free number services.

Microsoft Skype for Business Online PSTN Services Use Terms

1. Introduction

Microsoft and its affiliates (collectively “Microsoft”) have established these Use Terms (the “Terms”) to encourage our customers to responsibly use Skype for Business Online PSTN Services, and the online services infrastructure, systems, services, and web sites that provide those services (collectively “PSTN Services”), to help us provide more reliable and productive PSTN Services for all users.

The term “PSTN Services” as used in these Terms includes the Skype for Business Online Services known as PSTN Calling (both Domestic and International) and PSTN Conferencing. Any limitations on use specific to either PSTN Calling or PSTN Conferencing shall be clearly identified.

These Terms are not intended to supersede or modify your volume licensing agreement with Microsoft under which you obtained the PSTN Services. If there is any conflict between these Terms and your volume licensing agreement that is not expressly resolved by their terms, the volume licensing agreement controls.

These Terms set out rights and obligations for using these services, as well as the minimum standards of behavior required from you when you use the PSTN Services, including certain actions that are prohibited and quantitative limitations on scope of use applicable to specific PSTN Service subscriptions, what we may do if you fail to meet those minimum standards.

By using the PSTN Services you agree to be bound by these Terms.

2. Prohibited uses of PSTN services

2.1. The PSTN Services must not be used in any manner that may expose Microsoft or any of its personnel to criminal or civil liability,

2.2. Re-selling subscription minutes,

2.3. Calling PSTN telephone numbers (whether singly, sequentially or automatically) to generate income for yourself or others as a result of placing the call, other than for your individual business communications, or

2.4. Unusual calling patterns inconsistent with normal, individual subscription use, for example, regular calls of short durations or calls to multiple numbers in a short period of time.

3. Subscription limits on use of PSTN services

3.1. The PSTN Services are available via different subscription offers: PSTN Domestic Calling (domestic calling only); PSTN Domestic and International Calling (domestic and international calling); and PSTN Conferencing (VoIP meetings including PSTN dial-in and dial-out connectivity). PSTN Domestic Calling (domestic), for purposes of the PSTN Services, means the ability for the user to make calls to numbers located within the country of Office 365 assignment for that user. For example, for a PSTN Domestic Calling user who has been provisioned for PSTN Services with a location within the United States, that user may make PSTN calls to any of the 50 states.

For each PSTN Calling subscription plan, there is a cap on the maximum number of minutes that will be allowed per user, per calendar month during the subscription term. Subscription minutes will be pooled at the tenant level as per the following example:

For a US based PSTN Domestic Calling subscription, each user is allowed 3000 domestic calling minutes per calendar month (combining both inbound and outbound calling minutes). If the tenant customer purchases 10 user subscriptions of PSTN Domestic Calling, all assigned subscription users pool their minutes (e.g. 10 X 3000 min= 30,000 minutes of domestic calling allowed for that tenant, per calendar month). Tenants may add new subscriptions at various dates throughout a given month, and user subscriptions may be provisioned on different dates within a month. We will use calendar months to determine resets of pooled minutes for any tenant.

To continue the example, assume tenant purchases two US based PSTN Domestic Calling subscriptions on December 1, 2015. At that point, the tenant has a pool of 6000 domestic calling minutes to be used by the end of that calendar month (the end of December 31, 2015). Tenant adds another two PSTN Domestic Calling subscriptions on December 20; at that point the tenant’s monthly pooled minutes increase to 12,000. If tenant has not exhausted all 12,000 domestic calling minutes by the end of December 2015, none of the remaining minutes carry over to January 2016. Rather, the tenant’s monthly running minute total resets at 11:59:59 Dec 31 UTC, so that as of January 1, 2016 that tenant is once again allowed 12,000 domestic calling minutes, pooled from all of the tenant’s PSTN Domestic Calling subscriptions, to be used during the month of January.

The Standard minute caps for PSTN Calling and PSTN Conferencing subscription plans are as follows:

PSTN Domestic Calling:    

  • 3000 outbound domestic calling minutes per user/per month (United States and Puerto Rico)

  • 1200 outbound domestic calling minutes per user/per month (United Kingdom and France)

PSTN Domestic and International Calling:    

  • 3000 outbound domestic calling minutes or 600 outbound international calling minutes (whichever cap is reached first), per user/per month (United States and Puerto Rico).

  • 1200 outbound domestic calling minutes or 600 outbound international calling minutes (whichever cap is reached first), per user/per month (France and the United Kingdom).

Countries included for international calling coverage are specified in the service description.

PSTN Conferencing    There is not a specific cap for the number of dial-in minutes allowed for each PSTN Conferencing subscription, but we reserve the right to restrict and shut down dial-in or domestic dial-out PSTN conferencing to limit abuse and/or fraud and to maintain service performance. We also reserve the right to modify or remove PSTN conferencing dial-in number(s) previously assigned to you to maintain good quality of service.

3.2. Introductory period     PSTN Services are being offered for the first time to Microsoft’s online services customers as of December 1, 2015. In order to allow our customers to become familiar with the PSTN Services and to assess their actual call volume needs for certain paid services for their users, Microsoft is enhancing the PSTN Conferencing subscriptions for the first nine calendar months of commercial availability (between December 1, 2015 and September 1, 2017, the Introductory Period).

PSTN Conferencing    For the Introductory Period only, users attending meetings organized by licensed users may be allowed, based on permissions granted by the meeting organizer, to make dial-out calls from within the meeting to phone numbers in any one of the 44 countries listed in section 4.1 below.

At the end of the Introductory Period, beginning on September 1, 2017, all PSTN Service plan subscriptions will revert to the Standard terms enumerated above.   

3.3. Effect of tenant reaching pooled minute caps:

For PSTN Calling, once a tenant reaches the monthly pooled minute cap, all PSTN Services (except for emergency calling, as below) for numbers assigned to that tenant will be suspended for the remainder of the calendar month unless PSTN Consumption Billing is enabled. For PSTN Domestic and International Calling, service will be suspended upon exhaustion of the domestic or international monthly pooled minute cap, whichever occurs first. Service will resume automatically on the first day of the next calendar month following suspension.

When a tenant is approaching their monthly pooled minute cap, and when a tenant reaches 100% of the monthly pooled cap, we will send an email to the tenant administrator(s) identified for that Office 365 customer account, advising them that they are approaching the cap, or when they have reached the cap, respectively.

Emergency calling capability will not be suspended as a result of a tenant reaching their monthly calling minute caps.   

3.4. Microsoft may, at its sole discretion, modify these Terms from time to time. Changes made to these Terms will apply only prospectively to new or renewal subscriptions unless you choose to have those changes apply to an existing subscription.

4. Calls to Premium Rate Numbers

You agree that Microsoft will block all calls to phone numbers, whether 10-digit numbers or short codes, that result in an additional charge being assessed on the calling party (either directly or indirectly) by the called party. Often referred to as “premium rate” numbers, charges associated with these calls are not part of the Skype for Business PSTN Calling services and you, therefore, agree that such calls are not permitted.

5. Directory Listing Publication

For customers subscribing in European Union member states and countries in the European Economic Area member states, If you would like a Directory Enquiry listing (including an entry in the Phone Book) for your telephone number, it can be provided. Please contact Customer Care to make your request for publication

6. Availability

6.1. For the purposes of these use terms, the following countries comprise the countries to which the introductory period dial out capabilities in section 3.2 apply.

7. Effective date

This version of the Microsoft Skype for Business PSTN Services Use Terms is in effect for relevant licensing agreements executed from December 1, 2016 until the next version of the Microsoft Skype for Business PSTN Services Use Terms is published. In no case shall these terms extend beyond the end of the effective date of any Microsoft licensing agreement signed during the time that these terms are in effect.
